Welcome to www.dappas.com (together with its subdomains, content, Marks and services, the "Site"). Please read the following Terms of Use (the "Agreement") carefully before using this Site so that you are aware of your legal rights and obligations with respect to Dappas It Ltd. ("Dappas It", "we", "our" or "us"). By accessing or using the Site, you expressly acknowledge and agree that you are entering a legal agreement with us and have understood and agree to comply with, and be legally bound by, this Agreement, together with the Privacy Policy which is hereby incorporated into this Agreement by reference.
We reserve the right, at our discretion, to modify this Agreement at any time. Such modification will be effective ten (10) days following posting of the revised Agreement on the Site, and your continued use of the Site thereafter means that you accept those modifications.
The Site is only intended for individuals aged thirteen (13) years or older. If you are under 13 years please do not visit or use the Site. If you are between 13 and 18 years of age, then you must review this Agreement with your parent or guardian before visiting or using the Site to make sure that you and your parent or guardian understand this Agreement and agree to them.
For such time as this Agreement is in effect, we hereby grant you a personal, limited, non-exclusive, non-assignable, non-sublicensable, revocable right to access and use the Site solely for your own personal and non-commercial use, and provided that you comply with this Agreement. Except for the foregoing right, we do not grant you any right or licenses to any of our or a third party's Intellectual Property Rights.
As a condition to your right to access and use the Site, you shall not (and shall not permit or encourage any third party to) do any of the following: copy, reproduce, sell, assign, lease, rent, distribute, modify, reverse engineer, circumvent security, impersonate, or otherwise misuse the Site in any malicious, illegal or fraudulent way, or infringe any third party's Intellectual Property Rights.
In order to use some of the services of the Site, you may have to create an account ("Account"). You agree not to create an Account for anyone else or use the account of another without their permission. You are solely responsible for the activity that occurs in your Account, and you hereby agree to keep your Account password secure. You must notify Dappas It immediately of any breach of security or unauthorized use of your Account.
Your right to access and use the Site is currently for free, but Dappas It may in the future charge a fee for certain access or usage. You will not be charged unless you first agree to such charges.
We permit you to link to the Site provided that you do not replicate pages, misrepresent your relationship with Dappas It, or link from offensive or infringing websites. You must comply with this Agreement and applicable law when linking.
All rights, including Intellectual Property Rights, in and to the Site, Materials, and Marks are the sole property of Dappas It and/or its licensors. Feedback provided to us shall belong exclusively to Dappas It.
You are solely responsible for your User Submissions and grant Dappas It a worldwide, irrevocable, non-exclusive, royalty-free, perpetual, sublicensable and transferable license to use them in connection with the Site and our business. You also waive any moral rights to the extent permitted by law.
The Site may contain third party content or links. We are not responsible for such content, practices, or policies. Please read third party terms before engaging with them.
We will use any personal information collected in accordance with our Privacy Policy available at www.dappas.com/privacy-policy.
The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, and availability.
In no event shall Dappas It or its licensors be liable for any consequential, indirect, special, incidental, or punitive damages, or any loss of profits, data, reputation, or goodwill. The aggregate liability shall not exceed the lower of five U.S. dollars (US $5) or the amounts actually paid by you (if any) to Dappas It in the preceding three months.
You agree to defend, indemnify and hold harmless Dappas It and its affiliates, officers, directors, employees and agents from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses arising from your use of the Site, your User Submissions, or your breach of this Agreement.
We reserve the right to immediately terminate this Agreement or suspend your access to the Site at any time, without notice or liability. You may terminate this Agreement at any time by discontinuing use of the Site.
This Agreement shall be governed by the laws of the State of Israel, and the competent courts of Tel Aviv-Yaffo shall have exclusive jurisdiction with respect to any dispute.
